You want a fast divorce. You may be looking to remarry or perhaps you just want to be officially single. I totally understand. Once you get your spouse’s signature, I can usually get the divorce through in anywhere from 8 to 12 weeks. Unfortunately courts are not known for blazing speed and when it comes to divorces the court will almost always reject papers if there is any defect, no matter how minor. This is why I set a very high standard on myself when I am preparing your papers- this standard is “perfection”. While I can’t make the Court work faster, what I can do to speed up the process is to file in the proper county and make absolutely certain that there are no defects in the papers, no matter how minor, which could possibly cause the Court to reject the papers.
The first step- you must file in the right county
If you want a really fast divorce the most important thing is to file in the right county. Some counties are much quicker and much more efficient than others. I know where to file to ensure that your divorce goes through as fast as possible. I recently saw another lawyer’s site where he says that it takes 4 months for the court to process the papers. I am sure that this is true in the county where he is filing the papers. What is worse, in many counties if there is a problem with the papers they won’t tell you about it until months later. The lesson is, if you want your case to go through fast, you have to know what county fo file in.
Avoid mistakes & delays by using an experienced divorce attorney
When I prepare your papers, I use Drafting Libraries, a special program for lawyers which is designed to avoid clerical and other errors, and is constantly updated to incorporate the latest changes in the law. Most important, I myself, not a paralegal or junior attorney, prepare the papers and carefully screen them to make sure that everything is in order before I file them with the Court. I generally file the papers over the lunch hour, as the court is open then and I am almost always free at that time, and since my office is located less than 2 blocks from the courthouse. This means that once the papers are all ready, I will file them right away.
Once I have filed the papers I calendar the case up for about 10 weeks and I automatically follow up to make sure that there is no problem. In the unlikely event that there is a problem I follow up immediately to fix it. When you see ads for $200 divorces you should realize that in life, you usually get what you pay for. If a lawyer is offering a $200 divorce do you really think that he or she will be in a rush to file the papers right away when there is more profitable business to be had? And for that matter do you really think that it is the lawyer, and not the lawyer’s secretary, who is going to be preparing the papers for a $200 case? As to non- lawyers (paralegals) don’t get me started. Just realize that in NY anyone can call himself or herself a paralegal.
I am up front with people in that I tell them that the 8 to 12 weeks figure is an estimate, not a promise. This estimate is subject to court calendar congestion, vacations, etc.
